Company: Santana & Rivera, doing business as Savvy Swim ("we," "our," or "us"), Dallas, Texas
Website: https://savvyswim.com
Contact: hi@savvyswim.com · (817) 663-7665
1. Introduction
This Privacy Policy explains how Santana & Rivera collects, uses, shares, and protects personal information when you visit our website (https://savvyswim.com), use the Savvy Swim app on the web, iPhone, iPad, Mac, or Android ("the App"), submit a form, sign a service agreement, pay us, call or text us, or otherwise use our pool services. It also explains the choices and rights you have. Our service area is North Texas, and this policy is written to meet the Texas Data Privacy and Security Act and other U.S. privacy laws that apply to us.
2. Information We Collect
Information you give us:
- Contact details: full name, mobile phone number, email address, and service or billing address
- Pool and property details: pool size and type, equipment, gate codes, lock and pet notes, and other access instructions you provide
- Requests and agreements: project details, scheduling preferences, quotes, service plans, signed agreements (including the name you type to sign, the date and time, and the device and IP address used)
- Account information: your sign-in email and, if you choose, a password (stored by our authentication provider in hashed form, never readable by us), or your Apple or Google sign-in
- Messages you send us through the App, email, text, or phone
- SMS opt-in status, consent date/time, and the IP address or device from which consent was given
Information created when we service your pool: visit dates, technician name, water test readings, chemicals added, notes, and photos of your pool and equipment taken by our technicians. These are shared with you in visit reports.
Payment information: card payments are processed by Stripe. Your full card number goes directly to Stripe and is never stored on our systems; we receive the card brand, last four digits, expiration date, billing address, and payment status. For check and cash payments we record the amount, date, and method.
Location: if you tap "use my current location" on a quote form, your device asks for permission and, only if you allow it, shares your precise location once so we can find your pool. Precise geolocation is "sensitive data" under Texas law; we collect it only with your consent and use it only to locate the property you asked us to service. You can type an address instead. The App also uses your device's location, with permission, to show maps and driving directions; that location stays on your device unless you choose to share it. In the App you can also tap "Pin my pool location" to save your pool's exact spot from your phone's GPS; we use it only so your technician can find your pool and confirm the visit happened there.
Location of our technicians during visits: when a Savvy Swim technician starts a visit ("On my way") in our App, their work device shares its location with us while the App is open, until the visit is finished, so our office can see where the service truck is and record when the technician arrived at and left your pool. These location points are kept for 7 days; the arrival and departure times and distances are kept with the visit record.
Information collected automatically: when you visit the website or use the App we collect limited technical information such as browser and device type, pages and screens viewed, referring page, campaign tags, and approximate location derived from IP address, for security, fraud prevention, analytics, and site performance.
Property information for marketing to homeowners: to let homeowners in the Dallas–Fort Worth area know about our pool service, we keep a list of homes that appear to have a pool, built from public property records and our own observations. It may include the street address, map location, the owner name shown in public records, basic property facts (such as year built and home size), and a phone number or email when one is publicly available or provided to us. We use it only for our own outreach about pool service; we do not sell it. We contact these homeowners one at a time, we check the National Do Not Call Registry before calling, and we never send automated texts to anyone who has not given us consent. To be removed, call or text 817-663-7665 or email hi@savvyswim.com; we mark your home "do not contact" and stop all outreach.
3. How We Use Your Information
We use the information we collect to:
- Respond to your inquiries and requests for estimates
- Schedule, confirm, and remind you of appointments and visits
- Provide pool cleaning, maintenance, repair, and related services, and send you visit reports with photos and readings
- Create and secure your App account
- Bill you, process payments, and keep accounting and tax records
- Send you transactional communications (email, phone, and, if you opted in, SMS)
- Send marketing messages only where you have agreed to receive them; you can opt out at any time
- Provide customer support
- Measure and improve our website, App, and advertising (see Cookies below)
- Detect and prevent fraud, abuse, and security incidents
- Maintain records of consent, transactions, and communications, comply with our legal obligations, and enforce our Terms
We do not use your personal information for decisions that produce legal or similarly significant effects based solely on automated processing (profiling).
4. Categories of Personal Data and Who Receives Them
We share personal information only with service providers (processors) who handle it for us under contracts that limit their use to providing services to us and require them to protect it:
- Hosting, database, sign-in, and file storage: Supabase and Vercel
- Payments: Stripe
- Email delivery: Resend
- Text messages: our SMS messaging provider, only to deliver messages you requested
- Sign in with Apple and Google: Apple and Google, only if you choose those sign-in options
- Maps and directions: Apple Maps and Google Maps receive the address you look up
- Advertising measurement: Meta (Facebook), only if you accept marketing cookies on our website
We may also disclose information to law enforcement, regulators, or courts when required by law or to protect our legal rights or anyone's safety, and to a successor in a merger, acquisition, or sale of our business, which would remain bound by this policy.
We do not sell your personal data, and we do not sell or share sensitive data. If you accept marketing cookies, the Meta pixel may be used to measure and show our ads, which some state laws treat as "targeted advertising"; you can decline or withdraw at any time (see section 10).
5. SMS Information Sharing & Data Protection
Santana & Rivera strictly respects your privacy. No mobile information, mobile phone numbers, or SMS opt-in consent data will be shared with any third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors is permitted solely to support and operate the messaging program (for example, our SMS messaging service provider) and only as necessary to deliver the messages you requested. All other categories of personal information may be shared in accordance with this Privacy Policy, but text-messaging originator opt-in data and consent will not be shared with any third parties whatsoever.
SMS opt-in data is strictly used for the fulfillment of requested services, appointment reminders, quote follow-ups, account/service notifications, and direct customer support communications as requested by the user.
6. Data Retention
- Account and App data: kept while you have an account. When you delete your account, your sign-in and App data are deleted.
- Service records (visit reports, photos, readings, signed agreements): kept while you are a customer and for up to 3 years after service ends, to resolve warranty and service questions, unless you ask us to delete them sooner and no law requires us to keep them.
- Payment and tax records: kept for 7 years, as accounting and tax law require.
- Leads who do not become customers: deleted or anonymized within 2 years of our last contact.
- SMS consent records: kept for the duration of your relationship with us and up to 5 years thereafter to demonstrate compliance with telephone consumer protection laws.
7. Data Security
We use administrative, technical, and physical safeguards appropriate to the information we hold, including encryption in transit (HTTPS/TLS), encrypted storage by our hosting providers, database row-level access controls so each customer can see only their own records, role-based staff access, hashed passwords, and payment handling by a PCI DSS-certified processor. No system is perfectly secure; if a breach affects your personal information we will notify you and the authorities as required by Texas law and other applicable law.
8. Your Rights & Choices
Wherever you live, you may ask us to:
- Know and access the personal data we hold about you, and get a copy in a portable format
- Correct inaccurate personal data
- Delete personal data you provided or we obtained about you
- Opt out of targeted advertising, the sale of personal data (we do not sell it), and profiling
Delete your account in the App: open the App, go to Account, and choose "Delete my account". This deletes your sign-in and App data right away. Deleting your account does not cancel an active service plan; to stop service and billing, contact us as described in your service agreement. Information we must keep by law (such as payment and tax records) is kept only as long as required and then deleted.
How to make a request: email hi@savvyswim.com with the subject "Privacy request", call or text (817) 663-7665, or use the Support page. We will verify your identity using information we already have (for example, by confirming your email or phone number) before acting. You may use an authorized agent with your signed permission. We respond within 45 days, and may extend once by 45 more days when reasonably necessary, telling you why. Requests are free up to twice a year. We will not discriminate against you for exercising your rights.
Appeals (Texas and other states): if we decline your request, you may appeal by replying to our decision or emailing hi@savvyswim.com with the subject "Privacy appeal" within 60 days. We will respond in writing within 60 days of receiving your appeal and explain our decision. If your appeal is denied, you may contact the Texas Attorney General at texasattorneygeneral.gov or your state's attorney general.
Communication choices:
- SMS opt-out: Reply STOP, CANCEL, UNSUBSCRIBE, END, or QUIT to any text message from us at any time. Reply HELP for help.

9. Children's Privacy
Our website, App, and services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13, and we treat any personal data of a known child as sensitive data. If you believe a child has provided us with personal information, contact us and we will delete it.
10. Cookies, Analytics & Global Privacy Control
Our website uses strictly necessary cookies and local storage to run the site, keep you signed in, and remember your choices, plus first-party analytics (page views, clicks on call and booking buttons) stored on our own systems, and Vercel Speed Insights, which measures page load speed without cookies or identifying you. Marketing cookies, including the Meta pixel, load only if you choose "Accept" in our cookie banner. You can change your choice at any time with the "Cookie settings" link in the website footer.
We honor the Global Privacy Control (GPC) signal: if your browser sends it, we treat it as a request to opt out of targeted advertising and do not load marketing cookies.

Our website and App may link to third-party sites and services (for example, maps or payment pages). We are not responsible for their privacy practices; please review their policies.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time and will revise the "Last Updated" date above. If we make material changes, we will notify you through the website or App, or by email, before they take effect. Where the law requires your consent to a new use, we will ask for it.
